Terms of Service

1. Acceptance of Terms
Welcome to Digiklass! Digiklass is operated by Nutistu OÜ (registry code 14322776). By using our website and services at digiklass.ee, you agree to follow these Terms of Service. If you do not agree to these terms, please do not use our services.
These terms apply to all of our domains: digiklass.ee, its English-language version diclasso.com, and the supporting domains liitu.ee and classo.it (join links) and lingi.ee (short links).
2. Service Description and Scope
Digiklass is a free collection of web-based tools designed for the personal use of the registered user. The primary user group is teachers in their own teaching, but the tools are equally suitable for other private or small-scale events — for example, team activities at work, the programme of a party, a club's activities, or other similar situations. Our services include:
- Interactive educational games and quizzes
- Classroom management tools
- Poll and voting creation
- File collection features
- Time management and organization tools
- Sharing and join links (liitu.ee, classo.it) and short links (lingi.ee)
- Other educational applications
3. User Account
3.1 Account Creation
To use certain features, you must sign in with a Google account, Microsoft account, or register with email and password. When creating an account:
- You confirm that you are at least 13 years old
- You register as a private individual (not as an institution's official platform) and you are responsible for your use
- You agree to share your profile information (name, email, profile picture)
- You are responsible for the security of your account
- When registering with email and password, you must use a strong password and verify your email address
Session participants do not create accounts in Digiklass. Using your account as an institution's official platform is not permitted without a separate written arrangement with us.
3.2 Account Usage
You are responsible for all activities associated with your account. Please notify us immediately if you suspect unauthorized access.
3.3 Entering Other Persons' Data
If you enter the data of other persons (e.g., the names of students, employees, event participants, or club members) into a list, you are responsible for ensuring that:
- you have the right to do so under the applicable rules and law;
- you have considered whether a nickname, first name, or initials would suffice instead of the full real name (data minimisation principle);
- the relevant persons (e.g., the parents of minors) have been informed, where necessary, that you are using their or their children's names in a web-based tool.
The same applies to content that participants create during a session — for example photos, audio recordings, or written answers. If the stored content contains identifiable people (especially minors), it is your responsibility to ensure that this is permitted.
4. Acceptable Use
By using Digiklass, you agree to:
- Use the service only for lawful and educational purposes
- Not disrupt or damage the operation of the service
- Not attempt to access restricted parts of the system
- Not share illegal or inappropriate content
- Not use automated tools without permission
- Respect the privacy and rights of other users
5. User Content
5.1 Your Content
You retain ownership of all content you create or share through Digiklass (e.g., polls, game content, class data). You grant us permission to store and display this content only to the extent necessary to provide the service — we do not use your content for any other purpose.
5.2 Content Responsibility
You are responsible for all content you create, upload, or share. We do not monitor or moderate user content, but we reserve the right to remove content that violates these terms.
5.3 File Collection
When using the file collection feature:
- Files are stored in your Google Drive or Microsoft OneDrive account
- You are responsible for ensuring collected files comply with copyright and privacy requirements
- We are not responsible for the content of files submitted by third parties
6. Intellectual Property
6.1 Our Property
Digiklass, including its design, code, logo, and trademarks, is our intellectual property. You may not copy, modify, or distribute these without our written permission.
6.2 Open Source
Some components may use open-source libraries licensed under their respective licenses.
7. Third-Party Services
Digiklass uses third-party services:
- Google: authentication, Drive (file collection and encrypted backups)
- Microsoft: authentication (Azure AD), OneDrive
- Content Delivery Networks: jsDelivr, cdnjs, Google Fonts
- Opalstack: server hosting and email delivery
- Ko-fi: voluntary donations (see §10)
- DB-IP: country detection database, which we keep on our own server (no queries are made to their service)
Use of these services is subject to their respective terms of service.
8. Privacy
The processing of your data is governed by our Privacy Policy, which is an integral part of these terms.
9. Service Availability and Changes
Digiklass is a free service provided on an "as is" basis. We do not guarantee:
- Uninterrupted service availability
- Absence of errors
- Retention of specific features
We reserve the right to modify, suspend, or discontinue the service. For material changes — such as service discontinuation, removal of major features, change of ownership, or moving to a paid model — we will notify registered users by email at least 30 days in advance and, within a reasonable period, offer the ability to export your data (classes, games, polls, etc.) in JSON or another common format.
10. Donations and Support
Digiklass is and remains free for users. On our support page you may, if you wish, make a voluntary donation through the external service Ko-fi. The following applies to donations:
- a donation is a voluntary gift towards running the project — it is not a purchase of a product or service;
- donating does not grant additional features, priority support, any service level (SLA) commitment, or influence over which features we build;
- donations are non-refundable, except where the law provides otherwise;
- the payment takes place entirely within Ko-fi under their terms — we neither see nor store payment details;
- the limitation of liability in section 11 applies to donating users as well.
11. Limitation of Liability
To the extent permitted by law:
- Digiklass and its creator are not liable for any direct, indirect, incidental, or consequential damages
- We are not responsible for data loss, system failures, or other problems arising from use of the service
- Our total liability is limited to zero, as the service is free to users (a voluntary donation is not payment for the service — see §10)
12. Indemnification
You agree to indemnify and protect Digiklass and its creator from all claims, damages, and costs arising from:
- Violation of these terms
- Content you create or share
- Your activities while using the service
13. Changes to Terms
We may modify these terms at any time. Changes take effect upon publication on this page. Continued use of the service after changes constitutes acceptance of the new terms.
14. Termination
You may stop using Digiklass at any time. We may restrict or terminate your access if:
- You violate these terms
- You use the service illegally
- Your activities harm the service or other users
15. Governing Law
These Terms of Service are governed by the laws of the Republic of Estonia. Disputes shall be resolved in Estonian courts.
16. Severability
If any provision of these terms is found to be invalid, the remaining provisions shall remain in effect.
